Holding: Every use-of-force claim during an arrest, stop, or other seizure is judged under the Fourth Amendment's objective reasonableness standard.

- Judged from a reasonable officer on the scene, not 20/20 hindsight.
- Accounts for split-second judgments in tense, uncertain, rapidly evolving situations.
- Officer's intent doesn't matter. Good intentions don't save excessive force, and bad intentions don't make reasonable force unlawful.
- Resistance includes actively resisting or fleeing. Threat means an immediate threat to officers or others.
On shift: articulate all three factors in your report.

Tennessee v. Garner
471 U.S. 1 (1985)
Deadly force on a fleeing suspect only for a serious threat.
Holding: Deadly force to stop a fleeing suspect is a Fourth Amendment seizure. It is unconstitutional against an apparently unarmed, non-dangerous suspect.
- Deadly force may be used to prevent escape only with probable cause that the suspect poses a significant threat of death or serious physical injury to officers or others.
- For example: the suspect threatened you with a weapon, or committed a crime involving infliction or threatened infliction of serious physical harm.
- Must be necessary to prevent escape. Give a warning where feasible.
- Struck down the old "fleeing felon" rule: being a felony suspect alone is not enough.
On shift: flight alone ≠ deadly force.

City of Canton v. Harris
489 U.S. 378 (1989)
Agency liable for failure to train showing deliberate indifference.
Holding: A city or agency can be liable under 42 U.S.C. § 1983 for failure to train, but only when that failure shows deliberate indifference to people's rights.
- Deliberate indifference: the need for more or different training is obvious and likely to result in rights violations.
- Causation: the training deficiency must actually cause the injury.
- Not enough: one poorly trained officer, an occasional mistake, or "better training would have helped."
- Case arose from a detainee denied medical care in custody.
On shift: train, document training, follow policy, and get medical help for people in custody when needed.
